Anouncement from Computer Engineering Professors about Digital Evidence in Prosecution

PUBLIC ANOUNCEMENT

We, the teaching staff from computer engineering departments with signatures below, see it as part of our professional and conscious responsability, to share the following information about "digital evidences" which played an important role on recent criminal investigations and prosecutions, with public:

Digital Document:Both data content and header data like "creation and last save time" and "username, computer name of creator" of a digital document created on electronic media, can be easily and untraceabliy staged and forged. Therefore, a digital document which is not supported with other exact evidences does not bind people whose name appears on the content or header data, just like a paper document with no signature can't either.

Ownership of Digital Document:It can be spoken of the presence of a digital document on a storage environment owned by a person, only if during its acquisition, a secure copy of the sampling with proper technical measures allowing to check its authenticity later, is given to the owner too. Only in this conditions it can be spoken of a healthy, authentic evidence.

Document Creation and Tampering with Malicious Software:Malicious software are computer software designed to infect a computer without being detected by its user, to disrupt or prevent it from working or to tamper the stored data. Some malicious software are designed specificaly to inject forged documents to the infected computer. The claims of a document created by the legitimate users of a computer or that the contents of the files are authentic should be considered doubtful for a computer infected with a such malicious software.

We respectfully declare our belief that, this fundemental information summarized above being taken under consideration by judiciary offices, will increase the quality of judiciary services and prevent important judiciary mistakes and damages.
